Bira-Biro Terms of Service

Version 1.0 · Effective 24 October 2026

These Terms of Service ("Terms") are a legal agreement between you and Bira-Biro ("Bira-Biro", "we", "us" or "our") for the use of the Bira-Biro mobile application, the Bira-Biro website and any related services (together, the "Service"). Please read them carefully before creating an account.

By creating an account, tapping the box that accepts these Terms, or using the Service, you agree to these Terms and to our Privacy Policy. If you do not agree, do not create an account and do not use the Service.

1. Who may use the Service

The Service is designed for parents and legal guardians to create learning profiles for children aged approximately 4 to 9. You must be at least 18 years old, or the age of legal majority where you live, and you must be the parent or legal guardian of each child whose profile you create.

You are responsible for the child's use of the Service, for the accuracy of the information you provide, and for keeping your phone number and Google account secure. Children may not create accounts themselves.

2. Accounts and sign-in

We use passwordless sign-in. You can sign in with a phone number confirmed by a one-time code (SMS) or with a Google account. You are responsible for all activity that happens through your account. Tell us immediately at support@birabiro.app if you believe someone else has access to your account.

We may suspend or close an account if it is used in breach of these Terms, if we are required to do so by law, or if continuing to provide the Service would harm another person or the Service.

3. Children and parental responsibility

Child profiles are created and controlled by the parent or guardian. The information you add about a child (such as name, age, gender, grade and an optional disability status) is provided by you, with your consent as the child's parent or guardian. You may review, correct or delete a child's profile at any time in the app, or by contacting us.

The Service supports early learning. It is not a school, a medical device, a diagnostic tool or a substitute for professional educational, medical or developmental advice.

4. Licence to use the Service

Subject to these Terms and payment of any applicable fees, we grant you a personal, non-exclusive, non-transferable, revocable and limited licence to install and use the Service on devices you own or control, for your family's private, non-commercial use.

You may not:

5. Content and intellectual property

The Service, including its characters (including Efuyegela), artwork, audio, text, activities, software and trade marks, is owned by Bira-Biro or its licensors and is protected by Ethiopian and international intellectual-property laws. We grant you only the limited licence described above. All rights not expressly granted are reserved.

If you send us feedback or suggestions, you allow us to use them without restriction or payment. Drawings a child creates in the Art Studio remain the child's and your family's; we do not claim ownership of them, and they are stored on your device.

6. Internet access, downloads and updates

Some features need an internet connection. Offline activities, downloads and phone storage are your responsibility. We may release updates, and some updates may be required for security or compatibility. If you do not install a required update, part of the Service may stop working.

7. Fees

The current version of the Service is provided free of charge. If we introduce paid features, we will show the price and billing terms before you buy, and the purchase will also be subject to the rules of the app store you use.

8. Third-party services

The Service uses third-party services, including Google Sign-In and Firebase Cloud Messaging. Those services are governed by their own terms and privacy policies. We are not responsible for third-party services we do not control.

9. Disclaimers

The Service is provided "as is" and "as available". To the extent permitted by law, we do not promise that the Service will be uninterrupted, error-free or completely secure, or that it will produce a particular learning outcome. Nothing in these Terms removes rights you have under mandatory consumer-protection law.

10. Limitation of liability

To the extent permitted by law, Bira-Biro will not be liable for indirect, incidental, special, consequential or punitive damages, or for loss of data, profits, goodwill or opportunity, arising out of or connected with the Service.

Our total liability for all claims relating to the Service is limited to the greater of (a) the amount you paid us for the Service in the twelve months before the claim, or (b) ETB 5,000. This limitation does not apply to fraud, wilful misconduct, gross negligence, death or personal injury caused by our negligence, or any liability that cannot be limited by law.

11. Ending the agreement

You may stop using the Service at any time and may request deletion of your account by using the delete option in the app (where available) or by writing to privacy@birabiro.app. We may suspend or terminate the Service or your account as described in Section 2. Sections that by their nature should survive termination (including intellectual property, disclaimers, liability and governing law) will continue to apply.

12. Changes to these Terms

We may update these Terms to reflect changes in the Service or the law. If a change is material, we will notify you in the app or by another reasonable means before it takes effect. The version and effective date are always shown at the top of this document. Continuing to use the Service after a change means you accept the updated Terms.

13. Governing law and disputes

These Terms are governed by the laws of the Federal Democratic Republic of Ethiopia, without regard to conflict-of-law rules. Before starting a formal claim, please contact us at support@birabiro.app so we can try to resolve the issue informally. Subject to any mandatory consumer rights you have, disputes will be brought before the competent courts of Addis Ababa, Ethiopia.

If you are a consumer in the United States, nothing in this section prevents you from relying on mandatory protections of the state where you live.
